1. Acceptance of Terms

By accessing or using CropUp Ai (cropupai.com) you agree to be bound by these Terms and Conditions. If you do not agree to these terms do not use the service. These terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

CropUp Ai provides AI-powered prompt generation tools for creating content with AI image and video generators including Midjourney, ChatGPT, Sora, Higgsfield, Kling, and others. The service includes free tools available without registration and Pro tools available with a paid subscription.

We use the Anthropic Claude API to power our AI tools. By using CropUp Ai you acknowledge that your inputs are processed by Anthropic's API in accordance with Anthropic's usage policies.

3. User Accounts

Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You must be at least 13 years old to use CropUp Ai.

You may not use another person's account without permission. You must notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these terms.

4. Free and Pro Plans

CropUp Ai offers a free plan and a Pro subscription plan.

Free plan: Access to 14 free tools with no payment required. Free accounts can save up to 50 prompts and 3 prompt templates. The free plan is available indefinitely.

Pro plan: Access to all 21 tools including Pro-only features. Pro subscriptions are billed monthly at $9 per month or annually at $79 per year. Pro subscriptions include a 7-day free trial for new subscribers. Your card will be charged after the trial period ends unless you cancel before the trial expires.

We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Acceptable Use

You agree not to use CropUp Ai to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on the intellectual property rights of others
• Generate content depicting minors in any inappropriate manner
• Attempt to circumvent any usage limits or access controls
• Use automated scripts or bots to access the service in ways that exceed reasonable personal use
• Resell or redistribute access to CropUp Ai tools without our written permission
• Reverse engineer or attempt to extract the underlying AI systems
• Use the service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these acceptable use policies.

6. Intellectual Property

CropUp Ai and its original content, features, and functionality are owned by CropUp Ai and are protected by copyright, trademark, and other intellectual property laws.

The prompts, templates, and outputs generated by our tools are provided for your use. You retain ownership of the content you input into our tools. The AI-generated prompts produced by our tools are yours to use as you see fit, subject to the terms of the AI platforms you use them with (Midjourney, OpenAI, etc.).

You may not copy, modify, distribute, or create derivative works of the CropUp Ai platform itself without our written permission.

7. AI-Generated Content

CropUp Ai generates prompts and recommendations using AI. These outputs are provided as-is and may not always be accurate, appropriate, or suitable for your specific use case. You are responsible for reviewing and evaluating all AI-generated outputs before using them.

We do not guarantee that prompts generated by our tools will produce specific results in third-party AI tools like Midjourney or ChatGPT. Results depend on the third-party tool, your subscription level with that tool, and many other factors outside our control.

The AI models powering CropUp Ai are provided by Anthropic. Anthropic's terms of service and usage policies apply to all AI processing performed through our service.

8. Payment and Billing

Pro subscriptions are processed through Lemon Squeezy, our payment processor. By subscribing to Pro you agree to Lemon Squeezy's terms of service. Your payment information is processed and stored securely by Lemon Squeezy and is never stored on our servers.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorize us to charge your payment method on a recurring basis until you cancel.

If a payment fails we will attempt to collect payment again. If payment cannot be collected your Pro access may be suspended until payment is resolved.

9. Cancellation and Refunds

You may cancel your Pro subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain Pro access until the end of the period you have paid for.

We offer a 7-day money back guarantee on all Pro plans. If you are not satisfied within 7 days of your first payment contact us at contact@cropupai.com and we will issue a full refund. After 7 days all payments are non-refundable.

Free trial cancellations: Cancel before the trial ends to avoid being charged. If you forget to cancel and are charged you may request a refund within 7 days of the charge.

10. Disclaimer of Warranties

CropUp Ai is provided on an as-is and as-available basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not warrant that the prompts and recommendations generated by our tools will achieve any particular result in third-party AI tools. AI outputs are inherently variable and we cannot guarantee specific outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, CropUp Ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Privacy

Your use of CropUp Ai is also governed by our Privacy Policy available at cropupai.com/privacy-policy/. By using CropUp Ai you consent to the data practices described in our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by updating the Last Updated date at the top of this page and, where appropriate, by sending an email notification. Your continued use of CropUp Ai after changes take effect constitutes acceptance of the revised terms.
